SpinRise Terms of Service

These Terms of Service ("Terms") govern your use of the SpinRise mobile application and related services (the "Service") provided by SpinRise Technologies LLC ("SpinRise," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.
Eligibility and authority
You must be an adult who can enter into these Terms. SpinRise is intended for parents, legal guardians, authorized caregivers, and authorized professionals. You may provide or access a child's information only when you have authority from the child's parent or legal guardian and have obtained any other consent required by law.
Your account
You agree to provide accurate information, protect your credentials, and promptly notify us of suspected unauthorized use. You are responsible for activity under your account and for assigning care-team access only to people who are authorized to receive the relevant child's information.
Permitted use
You may use the Service for lawful personal, caregiving, or professional-support purposes. You may not:
- access or disclose another person's information without authorization;
- upload unlawful, harmful, deceptive, or infringing content;
- attempt to bypass security, probe the Service, introduce malicious code, or disrupt its operation;
- reverse engineer or misuse the Service except where applicable law expressly permits it; or
- use the Service in a way that violates law, professional obligations, or another person's rights.
Not medical advice or an emergency service
SpinRise is an information-recording and care-team support tool. It does not diagnose, treat, cure, or prevent any condition, and it is not a substitute for professional medical, behavioral, educational, or legal judgment. Do not rely on the Service for urgent decisions.
SpinRise is not an emergency service. If someone is in immediate danger, contact local emergency services.
Your content and care-team sharing
You retain your rights in content you submit. You give SpinRise permission to host, process, reproduce, and transmit that content only as needed to operate, secure, support, and improve the Service and meet legal obligations. People you authorize for a child's care team may be able to view or contribute information according to their access. You are responsible for the content you submit and for the access you grant.
Subscriptions and App Store terms
The SpinRise 6.0 release does not offer a purchase screen. If your account has an existing App Store subscription, Apple manages billing, renewal, cancellation, and refunds under Apple's terms. Deleting your SpinRise account does not cancel an App Store subscription. You must review or cancel it through Apple subscription settings.
Privacy
Our Privacy Policy explains how we handle personal information. Please review it before entering a child's information or inviting a care-team member.
Suspension, termination, and deletion
You may stop using the Service at any time and may request account deletion from the authenticated app. We may limit, suspend, or terminate access when reasonably necessary to address security risks, unlawful or harmful conduct, a material breach of these Terms, nonpayment of an applicable subscription, or discontinuation of the Service. Where appropriate, we will provide notice and an opportunity to resolve the issue.
SpinRise materials and feedback
The Service, its software, design, trademarks, and other SpinRise materials are owned by SpinRise or its licensors and are protected by law. These Terms grant you a limited, personal, nonexclusive, nontransferable, revocable right to use the Service. If you provide suggestions or feedback, you allow us to use them without restriction or payment, without identifying you publicly.
Third-party services
The Service may depend on or link to services operated by others, including Apple and hosting or email providers. Their terms and privacy practices may apply to their services. SpinRise is not responsible for third-party services it does not control.
Availability and changes
We work to keep the Service available and reliable, but we do not promise uninterrupted or error-free operation. Features may change, and we may update or discontinue parts of the Service. Preserve any information you independently need for care or legal records; SpinRise should not be your only copy of critical information.
Disclaimers and limitation of liability
To the fullest extent permitted by law, the Service is provided "as is" and "as available," without warranties of merchantability, fitness for a particular purpose, noninfringement, or that the Service will meet every requirement. To the fullest extent permitted by law, SpinRise and its officers, employees, and contractors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, profits, or opportunities, arising from use of or inability to use the Service. Nothing in these Terms excludes rights or liability that applicable law does not allow us to exclude.
Changes to these Terms
We may update these Terms as the Service or legal requirements change. We will post revised Terms with a new date and provide additional notice when required. Continuing to use the Service after an update takes effect means you accept the revised Terms.
